Terms of Service

1. About these terms

CustomerClarity is a data analysis service operated by Ubiquitous LLC, a Connecticut limited liability company (“we,” “us,” or “our”). By uploading a file to CustomerClarity or using any part of the service, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What CustomerClarity does

CustomerClarity allows you to upload a CSV file containing customer or contact records and receive an automated analysis identifying likely duplicate records, conflicting details, and data quality patterns.

The service produces:

• An interactive analysis viewable in your browser
• A downloadable PDF summary report
• An interactive HTML drilldown document

CustomerClarity is an analysis and review tool. It does not modify, merge, delete, or write data to any external system. All actions taken on your data based on this analysis are your own responsibility.

3. Data handling and privacy

We take your data seriously. Please read the following carefully:

• Your uploaded file is processed in memory and is never written to a persistent database or storage system.
• Your data is retained in server memory for up to one hour after upload, after which it is discarded.
• We do not share, sell, or transfer your data to any third party.
• Generated reports (PDF and HTML drilldown files) are stored temporarily on our servers and are accessible only via a private, unguessable URL. These files are automatically deleted within 30 days of generation.
• We may collect anonymised usage data (e.g. number of records analysed, general error logs) for the purpose of improving the service. This data contains no personally identifiable information from your uploaded file.

4. Accuracy and limitations

CustomerClarity uses automated pattern matching to identify likely duplicate records. The analysis is provided for informational and review purposes only.

• Results are probabilistic, not definitive. The service may produce false positives (records incorrectly grouped) or false negatives (duplicates not detected).
• Assessments such as “Likely multiple customers incorrectly grouped” are observations based on detected patterns and are not legal, financial, or professional advice.
• You are solely responsible for verifying any findings before taking action in your accounting, CRM, or other systems.
• We expressly disclaim any liability for decisions made based on CustomerClarity output.

5. Acceptable use

You agree not to use CustomerClarity to:

• Upload data you do not have the legal right to process
• Upload data containing sensitive personal information beyond what is necessary for customer record analysis
• Attempt to reverse-engineer, scrape, or automate the service in ways not intended by its design
• Use the service for any unlawful purpose or in violation of applicable privacy laws

You represent that you have obtained any necessary consents or have a lawful basis to process the data you upload.

6. Beta service

CustomerClarity is currently offered as a beta service. During the beta period:

• Features, pricing, and availability may change without notice
• The service is provided “as is” without warranty of any kind
• We reserve the right to suspend or discontinue the service at any time

Beta pricing (including free access) is offered at our discretion and may be withdrawn at any time.

7. Payment

When payment processing is active, fees are charged per analysis based on the number of records in your uploaded file. All sales are final. We do not offer refunds except where required by applicable law. During the beta period, no payment is required.

8. Intellectual property

The CustomerClarity service, including its design, code, analysis methodology, and output format, is the property of Ubiquitous LLC. You retain all rights to your uploaded data and to the factual content of your analysis results. You may not reproduce or redistribute the CustomerClarity interface or methodology without written permission.

9. Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that results will be accurate or complete.

10. Limitation of liability

To the fullest extent permitted by applicable law, Ubiquitous LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of CustomerClarity, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to these terms shall not exceed the amount you paid us in the three months preceding the claim.

11. Governing law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Connecticut.

12. Changes to these terms

We may update these Terms from time to time. We will indicate the effective date at the top of this page. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.
